BCC Disclaimer

Players and Parents/Guardians are advised to carefully read the Disclaimer, Risk Warning, Helmets and Safety and Privacy statements below before registering as they affect your legal rights and those of the applicant player.

The Club (Berowra Cricket Club) reserves the right to accept or decline any registration at any time during the competition year. Registration will not be accepted without full payment of the required fees prior to the commencement of the first game of the season and is subject to team availability. Team selections will be made with preference to fully paid members in the first instance.

You should be aware that there are risks of injury associated with playing cricket, as there are with most sports. Risk will arise in the context of the activities of batting, bowling and fielding. While the Club aims to minimise risks, it is not possible to eliminate them all. On some occasions, an injury can be serious (such as torn ligaments, dislocations, back injuries, concussion or broken bones). In very rare cases the injury can be life threatening or result in permanent disability. If a participant has a pre-existing injury, participating in a sporting activity could result in an exacerbation of that injury. It is also strongly recommended by the Club that personal insurance be taken out by participants. On registering the participant also gives permission for the club to arrange any medical attention that may be required, including ambulance transport and agree to pay all medical costs incurred by him/her.

On registering you as the player or the players parent/guardian acknowledge and understand the risk warning and exclusion of liability on this Disclaimer and give permission for the participant registering to participate in the above activity/training/game/event.

On registering, you as the player or the players parent/guardian hereby agree that the BEROWRA CRICKET CLUB INC (“The Club”), its officers, officials and/or members  shall not be liable, whether in contract, tort or statute for any injury, illness, loss or damage or other mishap to you/your child or your/your child’s property arising out of, or in any way directly or indirectly connected with your/your child’s participation in any event, match, competition, practice or training  and will at all times indemnify and keep fully indemnified the Club from and against all actions, suits, causes of action, proceedings, claims, demands, costs and expenses whatsoever which may be taken or made against the Club arising out of any such injury, illness, loss, damage or other such mishap to you/your child or your/your child’s property.

The wearing of a helmet and appropriate safety equipment is compulsory for all junior players while batting, fielding within close proximity of the batter (when applicable), and when wicket-keeping up to the stumps. The Club also recommends all senior players to wear helmets and appropriate safety equipment while batting, fielding within close proximity of the batter, and while wicket- keeping up to the stumps. The Club supplies two (2) helmets and a number of protectors for each junior team, in doing so the Club does not accept any responsibility for incidents arising out of allegations concerning the fit of the helmet and/or protector, or for any hygiene factor. It is recommended that players and/or parents having any concerns regarding helmets and/or protectors should purchase such from a recognized supplier and ensure that the purchase meets Australian Standards.

In addition, the Club expects all players to take responsibility for their own safety by observing instructions, rules and guidelines, by wearing compulsory safety equipment when applicable and by behaving in a safe and responsible manner towards other participants, officials, property and grounds.

Unless otherwise notified on registration, you as the player or the players parent/guardian agree to your/your child’s name/photo being published in BEROWRA CRICKET CLUB INC (“The Club”) newsletters, the club website, club social media and local newspapers for the sole purposes of acknowledgement and commendation only.
